Wrongful Death Lawsuit Filed Regarding I-55 Truck Accident

There has been a wrongful death lawsuit filed in Cook County Circuit Court Friday regarding a fatal accident on July 21, 2014, in which one semi “rear-ended” another semi truck, resulting in the death of one of the drivers, Deividas Mockus.

The wrongful death lawsuit was filed against the driver’s employer and the company that supplied the truck driven.  The lawsuit alleges that the truck’s braking system malfunctioned, thereby causing the fatal accident.

The fatal Illinois truck accident is described in the Chicago Sun-Times Voices article dated July 25, 2014, titled “Widow of truck driver killed in I-55 crash sues his employer, supplier.”

Two excerpts regarding the lawsuit:

According to the suit, Mockus attempted to stop the semi before the crash when the trailer’s brakes malfunctioned and the truck collided with another vehicle.

The suit claims that both Mediterranean and Direct Trucking negligently failed to inspect the trailer and make sure it was in safe, working condition before Mockus was hired to transport it.

Illinois Injury Lawsuits Filed Regarding Naperville Pedestrian Accident

There have been two Illinois personal injury lawsuits filed over a Naperville pedestrian accident that happened on July 12, 2013.  The underlying accident involved a car that struck two pedestrians during a Waubonsie Valley High School driver’s education class.

The teen driver from Naperville was 15 years old at the time of the accident.  According to the police accident report, the accident happened after the teen driver made a right-hand and  “somehow kept pressing the gas pedal instead of the brake” and lost control of the car.  The car jumped the curb, ran over a parking sign, and then struck two female pedestrians, including a mother who was pushing a stroller.

While the mother was able to push the stroller away from the oncoming car, both women were injured and taken to Edward Hospital and Health Services in Naperville for treatment of injuries.

The other victim (the one not with the stroller) claims in the lawsuit that she sustained injuries “to her muscles, bones and nervous system.”

An excerpt from the TribLocal Naperville & Lisle article of July 15, 2014, titled “Naperville student sued for striking pedestrians in driver’s ed class“:

The student driver, now 16, was ticketed for failure to reduce speed to avoid an accident and improper lane usage, according to the police report and court records. The latter ticket was dismissed, and she was placed on court supervision and fined more than $300 for failing to reduce speed, records state.

ATV Safety Issues For Teenage Riders

All-terrain vehicle (ATV) and UTV safety has been a continual concern given the frequency and extent of accidents and injuries, especially those involving teenagers and children.

Medline Plus (National Institutes of Health) published a document today (July 14, 2014) titled “Teens, ATV a Dangerous Combo.”  The article discusses a study’s findings regarding Iowa teens and the incidence of ATV accidents and injuries.

A couple of excerpts:

“More kids younger than 16 are dying from ATV crashes than from bicycle crashes. We talk a lot about bicycle safety, but there isn’t enough discussed with kids and families about safety when riding an ATV,” said study author Dr. Charles Jennissen, a clinical associate professor of pediatrics and emergency medicine at the University of Iowa Carver College of Medicine.

Since 2001, kids aged 15 and younger have represented nearly 30 percent of all ATV-related injuries and one-fifth of ATV-related deaths in the United States, the authors said in their study, which appears in the July/August issue of the Annals of Internal Medicine.

Previous studies have indicated that young ATV operators have a 12 times greater risk of injury compared with adults, the study authors noted.

For example, an ATV’s tires are designed for off-road use. “They aren’t designed for road surfaces,” she said. “They make it more difficult to control and easy to crash. And on the road, in an accident with a car, the car always wins.”
