Wrongful Death Lawsuit Filed Regarding Fatal I-55 Crash

There has been a wrongful death lawsuit filed in Cook County Circuit Court regarding the fatal truck accident that happened on July 21, 2014 on I-55.  That accident resulted in the deaths of five people, and was further described in the July 22, 2014 post titled “Fatal I-55 Truck Accidents In Will County.”

Now, the son of Vicky Palacios (one of those killed) has filed a wrongful death lawsuit against the truck driver and the trucking company.  The truck driver, Francisco Espinal-Quiroz, 51, of Leesburg, IN, has been charged with reckless homicide in the accident.

The wrongful death lawsuit is described in the August 13, 2014 mysuburbanlife.com article titled “Son of woman killed in I-55 crash sues truck driver.”  An excerpt from the article:

The suit alleges Espinal-Quiroz, 51, of Leesburg, Indiana, acted “carelessly, negligently and improperly” and “willfully and wantonly” the day of the crash, disregarding the construction zone’s speed limit, failing to slow and stop his semitrailer and improperly changing lanes.

The suit also accuses Espinal-Quiroz of carelessly and willfully violating federal law by driving beyond the number of hours allowed by law and falsifying his log book. The suit is seeking damages in “excess of $50,000.”

Additional details and possible updates concerning this wrongful death lawsuit can be seen in a variety of media sources, including the mysuburbanlife.com article mentioned above, as well as the August 28 Chicago Sun-Times Voices article titled “Reckless homicide charges against trucker in fatal I-55 crash.”
