Illinois Wrongful Death Lawsuit Involving Elopement

There has been an Illinois wrongful death lawsuit filed regarding a woman that wandered from the Trinity Services group home in Lockport and was killed in an accident.

The wrongful death lawsuit was filed in Will County Circuit Court, by the daughter of the woman who was killed.

The woman killed was Tina Marie Douglas.  She was killed after escaping from the Trinity home, at which point she was struck and killed by a car in the early morning hours of October 27, 2013.

According to the lawsuit, Douglas had a history of elopement (commonly called wandering.)

An excerpt from the October 21, 2014 Joliet Patch article titled “Daughter of Disabled Woman Run Over & Killed After Escaping Group Home Files Wrongful Death Lawsuit“:

Douglas suffered from a “psychotic disorder, mild mental retardation, a seizure disorder secondary to a traumatic head injury, and memory deficits,” according to the lawsuit filed in Will County court.

In October 2013, Douglas, 48, lived in a Lockport group home run by Trinity Services, the suit said.

Trinity workers “knew of Tina Marie Douglas’ history of eloping or attempting to elope from her residential site, including elopements where she was placed in jeopardy of being severely injured or killed,” the suit said.

Also, according to the lawsuit, seven weeks before the fatal accident Douglas also escaped from the facility and was nearly hit by two automobiles.

This wrongful death lawsuit alleges that Trinity Services was negligent in supervision of Douglas.  An excerpt from the October 24, 2014 Southtown Star article titled “Woman sues Trinity Services over Mom’s Death“:

The suit alleges that Trinity Services failed to properly supervise Douglas and failed to transfer her to a more secure facility after the earlier escape from the Lockport group home.

Illinois Personal Injury Lawsuit Regarding Bicycle Accident

A personal injury lawsuit has been filed regarding an Illinois bicycle accident that happened in Mascoutah.

This bicycle accident happened in October 2012, and the lawsuit was filed in St. Clair County Circuit court on September 29, 2014.  The bicyclist (plaintiff) is Daniel Moseley, who claims that he was hurt after he was hit by a car driven by Julia Yoder (defendant.)

An excerpt from the Madison Record article of October 14, 2014, titled “Bicyclist sues after being hit by car in Mascoutah“:

According to the petition, Moseley was riding his bicycle north on North Jefferson Street in October 2012. As he neared the intersection of Grand Prairie View, Moseley claims he was hit from behind by a Pontiac Grand Am being driven by Yoder. Moseley says he was knocked off the road and thrown to the ground.

As further described in the article, the lawsuit claims negligence on the part of Yoder, and seeks compensation for various damages.

Cook County Circuit Court Lawsuit Filed Regarding September 13 Car Crash

There has been a Cook County Circuit Court lawsuit filed regarding a September 13, 2014 car crash, in which five people were in Philip Cho’s car when it crashed in the 700 block of West Erie in Chicago.

The lawsuit was filed Wednesday by three people who were in the car.  Of the three plaintiffs, Kelsey Ibac suffered a spinal cord injury during the accident and is now paralyzed from the waist down;  Brittney Zingsheim suffered a severed thumb as a result of the crash; and Bradley Schaum suffered lacerations to the back of his head.

The accident happened after Cho lost control of the car he was driving, at which point the car crashed into utility poll, rolled over and down an embankment.

Cho allegedly fled the scene accident, leaving the other occupants behind in the wreckage.

An excerpt from the October 9, 2014 Naperville Sun article titled “Woman paralyzed in car crash sues Naperville man“:

The 12-count suit is seeking more than $600,000 and is suing The Mid and Hubbard House Inn under the Dram Shop Act. It is also suing Cho and his employer, Pure Sole Entertainment, for negligence.

Man Files Illinois Lawsuit After Slipping And Falling

Fatal Car Crash On The Bishop Ford Freeway

There was a fatal car accident early Sunday morning (October 5, 2014) on the Bishop Ford Freeway on Chicago’s South Side.

According to the Illinois State Police (ISP) this fatal accident happened at approximately 2:30 a.m. on the Bishop Ford near South Cottage Grove Avenue.  The crash involved a car that ran into the back of a semi truck that had slowed as it approached a construction zone.

During the collision, the car became stuck under the semi truck.

The two men inside the car were declared dead at the accident scene.  According to the Cook County Medical Examiner’s Office, they were identified as Darryl B. Clark, 26, of Chicago, and Lamont F. Taylor, 25, of Chicago.
