Illinois Personal Injury Lawsuit Filed Regarding Parking Lot Accident

There has been an Illinois personal injury lawsuit filed in DuPage County Circuit Court regarding alleged injuries sustained by a woman as she was walking in a Walmart parking lot.

The lawsuit was filed by Joan Baratta, a resident of Elmhurst.

According to the lawsuit, the injuries happened on April 1, as Joan Baratta was at the Walmart in Villa Park.

An excerpt from the November 17, 2014 Elmhurst Patch article titled “Woman Sues Walmart Over Claims She Was Mowed Down By Shopping Carts“:

According to the complaint, Baratta had finished shopping and was walking back to her car through the parking lot. At the same time, an employee was gathering shopping carts, placing them in a long line and then pushing the line back toward the store.

The plaintiff alleges she was mowed down by the carts, and was knocked unconscious when she fell on the ground. She suffered a concussion, a deep cut in her scalp, a dislocated shoulder, and neck and back injuries, the complaint states.

An excerpt from the November 26 mysuburbanlife.com article titled “Elmhurst woman sues Wal-Mart after allegedly being injured at Villa Park store“:

Baratta is suing Wal-Mart Stores Inc. for compensatory damages exceeding $50,000, in addition to legal expenses, for failing to exercise reasonable care for her safety while lawfully on the company’s property, according to the complaint.

Illinois Wrongful Death Lawsuit Regarding Fatal Collision

There has been an Illinois wrongful death lawsuit filed in St. Clair County Circuit Court regarding a 2013 fatal vehicle collision.

The original fatal vehicle collision happened on October 25, 2013 on Interstate 55 near the Mt. Olive exit, in Litchfield, Illinois.

At the time of the accident, the Illinois State Police (ISP) reported that a 2002 Ford van “rear-ended” a 2002 Chevy Impala that for reasons unknown had either substantially slowed or stopped on I-55.

As a result of the accident, one adult and two children died at the accident scene.  As well, at least four other people were injured, including the drivers of both the Impala and Ford van.

The lawsuit is summarized in the Madison Record article of November 11, 2014, titled “Lawsuit filed after two children killed in crash.”

An excerpt:

Because of the collision, Alicea and Annastashia McGee suffered severe and catastrophic injuries that led to their deaths, the suit states. Their relatives have been deprived of their love, companionship, society and support, the complaint says.

Dyer-Webster blames the defendants for causing the collision, saying they negligently failed to keep their vehicle under proper control, failed to keep a proper lookout and failed to pull a vehicle off the traveled portion of the highway.

Lawsuit Filed Regarding Death Of Bicyclist On North Branch Trail

There has been an Illinois wrongful death lawsuit filed regarding the death of Molly Glynn, who died in September after a tree fell on her while she was bicycling September 5 on the North Branch Trail.

The accident happened on September 5 around 3:00 p.m. as Glynn was bicycling on the North Branch Trail near Willow Road.  A tree fell on her after a wind gust occurred as part of a storm that quickly formed.  Glynn was taken to Evanston NorthShore Hospital, where she died the next day.

This wrongful death lawsuit was filed by her husband, Joe Foust, in Cook County Circuit Court, against the Forest Preserve District of Cook County.

The lawsuit alleges that the Forest Preserve District of Cook County was negligent.

An excerpt from the Chicago Tribune article of November 7, 2014 titled “Molly Glynn’s husband sues Forest Preserve District in actress’s death“:

The suit claims negligence, alleging that the district failed to inspect, prune and maintain the trees and failed to warn people using the bike path that the trees were unsound.

The suit also alleges that such a failure to inspect the trees was done “with an utter indifference and conscious disregard for the safety of the public and Molly Anne Glynn.”
