Lawsuit Regarding Chicago Lakefront Path Accident

There has been an Illinois personal injury lawsuit filed over an accident on the Chicago lakefront bike path.  The lawsuit has been filed against the City of Chicago, the Chicago Park District, and A&L Inc., the company that constructed the bike path at the accident scene.

The bicycling accident happened on April 25, 2014 at approximately 8:00 p.m., as a bicyclist, Jennifer Kraft, 34, of Chicago, was riding on the path at 37th Street.

According to the lawsuit, Kraft was riding northbound at the time, when the bike trail “abruptly ended” and she fell nine feet onto concrete below.

As a result of the accident, the lawsuit claims she suffered accident injuries including three fractured neck vertebrae, fractured shoulder blades and a punctured spine.  She is said to be paralyzed from the chest down.

The lawsuit claims the city was negligent because there were no signs or rails to prevent the crash and that the curve “does not allow a user … to decipher whether the trail comes to an abrupt end or continues on.”

Cook County Wrongful Death Lawsuit Filed Regarding Fatal House Fire

There has been an Illinois wrongful death lawsuit filed regarding a fatal Chicago house fire that resulted in the death of Nathaniel Beler, his daughter, and the child’s mother in late 2012.

The underlying incident involved the father, Nathaniel Beler, setting himself, his daughter, Nariyah, his son, and their mother on fire in a bathtub filled with gasoline.  The children’s mother died at the scene of the fire, whereas Beler died the next day. Nariyah died three days later, after being burned over 98 percent of her body and died three days later, according to the suit. Additionally, Beler’s sone, Naciere, was burned as well.

The lawsuit was filed Monday (December 29, 2014) in Cook County Circuit Court by Robert F. Harris, the appointed estate administrator of Nariyah Beler and the public guardian of her brother, Naciere. The lawsuit was filed against Association House, a Humboldt Park-based welfare agency.

Chicago Construction Site Accident At Canal And Lake Streets

There was a Chicago construction site accident Monday (December 29, 2014) in the Loop, involving a steel beam that collapsed.  Three construction workers who were on the beam were injured, as well as a worker who was standing near the collapse.

This construction site accident happened in the West Loop at Canal and Lake Streets at approximately 9:05 a.m.  The construction beam fell from a distance of about 20 feet above ground.

According to an Occupational Safety and Health Administration (OSHA) spokesman, the beam collapsed after two bolts sheared off.

Two workers were taken in serious-to-critical condition to Northwestern Memorial Hospital, another in serious-to-critical was taken to John H. Stroger, Jr. Hospital of Cook County and the fourth, in fair-to-serious condition, was transported to Rush University Medical Center.

The building being constructed is supposed to be 50 stories tall.

Man Breaks Leg After Falling Into Sewer In Orland Park, Illinois

A man fell into an open sewer in Orland Park early Saturday evening, December 27, 2014.

According to the Orland Park Fire Department, the accident happened at approximately 5:49 p.m., as the man was walking back to his car at 151st Street and Harlem Avenue.

The man, said to be from Chicago’s South Suburbs, was able to call 911 for help from his cellphone.

The Orland Park Fire Department was able to extricate the man, who had fallen about 20 feet.  He was then taken to Advocate Christ Medical Center in Oak Lawn for treatment of accident injuries, which included a broken leg.

Fatal Dog Attack On Christmas Day

There was a fatal dog attack on Christmas Day that led to the death of the dog’s owner.

The attack happened at a house in Portage, Indiana.  Authorities were called to the house at approximately 8:14 p.m., responding to a report of a man, Edward L. Cahill, 40, of Portage, found unresponsive after an apparent dog attack.  He had dog bites to his face and arms.

An excerpt from the December 26, 2014 NBC Chicago article titled “Indiana Man Mauled to Death by Pet Dog on Christmas“:

When police arrived, they found Cahill dead on the floor covered in blood and with multiple lacerations on his face and arms, according to the report. Porter County Coroner Chuck Harris pronounced Cahill dead at the scene and ruled his death a dog mauling.

It was determined that a pet pit bull, which was reportedly aggressive in the past, was responsible for the attack.

Pit Bull Attack In Chicago’s Roseland Neighborhood

There was a dog attack Tuesday afternoon (December 23, 2014) in Chicago’s Roseland neighborhood on the South Side.

The attack happened after a pit bull escaped its owner’s home, ran down the street and attacked a 10-year-old boy.

The boy, Devon Williams, was attacked on his own porch.

Devon’s mother came to his assistance, but the pit bull also attacked her.

Accidents Along Chicago’s Lakefront Bike Path

Chicago’s lakefront bike path is heavily traveled, especially during peak periods in good weather conditions.

As those familiar with the path know, the path has many users, including many runners, bicyclists, rollerbladers, and walkers.  As well, in addition to being a recreational path, it is also used by those using the beaches.

Given the path’s popularity – yet relatively narrow width in many sections – there exists the possibility of accidents, especially given the mix and relative speeds of the different users, as well as people turning around on the path as well as crossing it.

Given these dynamics, it is not uncommon for collisions and other accidents to happen among the various path users.

As well, there are a number of areas in which the path crosses busy streets, and hazards can also be present at these street crossings.

The December 10, 2014 DNAinfo article titled “Runner Injured on Lakefront Path Pushes To Separate Cyclists, Other Users” highlights a runner who was injured on the lakefront path near Diversey on September 23.  She was running along the path and a bicyclist collided with her.  During this accident, she is reported to have suffered extensive injuries and hospitalization.  (Her accident is also discussed in the October 12 Chicago Sun-Times article titled “Jogger can’t recall being hit by bike, but bruises make it real.”)

Illinois Personal Injury Lawsuit Filed Over Slip & Fall Accident

There has been an Illinois personal injury lawsuit filed regarding an alleged slip & fall accident at a senior living facility in Glen Carbon, Illinois.

The plaintiffs allege the driveway was filled with an unusual amount of ice, and it was the responsibility of the defendant to properly design and maintain the driveway so water and ice could not accumulate to such an extent. This was a problem that existed despite multiple complaints by the plaintiffs, the suit states.

The suit states Mueller’s fall on the ice caused injury of mind and body, resulting in him being unable to perform his normal affairs.

Foster claimed that he and his wife were walking through the parking lot of the Wood River Walmart toward the store entrance on Dec. 1, 2010, when Byrd struck him as she attempted to back her vehicle out of its parking space. Foster was knocked down.

Because of the accident, in addition to his severe injuries, Foster alleged that he suffered pain, lost wages, lost his enjoyment of life and experienced suffering and disability.
