Filed May 20, 2014, after the death of 55-year-old Tim Miller on May 12, 2013. The suit alleges Miller was dehydrated and was suffering from malnutrition.

Filed May 6, 2013, in the death of 93-year-old Mildred Hale who died on Dec. 1, 2012 after allegedly suffering a foot fracture and bed sores. Lawsuit alleges that the center was unwilling to fire “incompetent employees.” Pending.

Wrongful Death Suit For Fatal Naperville Pedestrian Accident

There has been a wrongful death lawsuit filed in DuPage County regarding the pedestrian accident that led to the death of Emily Driscoll, 22, of Naperville.  That fatal accident happened on November 9, 2014 in Naperville at the intersection of Book Road and Rickert Drive.

According to Naperville Police, the accident happened at approximately 8:15 p.m. on November 9, 2014, as Emily Driscoll, 22, and her dog were attempting to walk across the intersection of Book Road and Rickert Drive.  At that time, they were struck by Kenneth E. Holmberg, who at the time was driving a 2001 Chevrolet Malibu.

Driscoll died after being taken to Edward Hospital in Naperville. The dog also died.

The lawsuit was filed by Emily Driscoll’s father, against the driver of the car, Kenneth E. Holmberg, of Plainfield.

An excerpt from the Daily Herald article of March 20, 2015, titled “Naperville crash victim’s father sues driver who hit her“:

Holmberg was cited several days after the crash by Naperville police for disobeying a red light and failing to exercise due care to avoid the crash.

An excerpt concerning the wrongful death lawsuit, as seen in the March 21 Naperville Patch article titled “Family of Naperville Woman Killed While Walking Her Dog Sues Driver“:

The lawsuit alleges wrongful death and suggests Kenneth Holmberg, 74, drove with “willful and wanton disregard for the safety of persons and property.”

Cook County Jury Awards $26 Million For Taxi Accident Injuries

A Cook County jury has awarded nearly $26 million to a man and his wife with regard to a taxi accident that happened on Interstate 294 (I-294) in 2005.

The man, Marc M. Jacobs, a lawyer at the time of the accident, was injured in the Augst 31, 2005 crash when the taxi that he was a passenger in crashed into a concrete barrier after the taxi driver lost control of the cab.

An excerpt from the March 17, 2015 Daily Herald article titled “Jury gives millions to man who was injured in 2005 taxi crash“:

In August 2005, Jacobs was riding in a taxi back to his Hinsdale home. The taxi was speeding on I-294 as it exited at Ogden Avenue, the release said, and it ended up on a grass drainage area near the ramp and then zoomed 32 feet through the air and crashed into a concrete barrier.

According to the lawsuit, as a result of the accident Jacobs suffered severe brain damage and as such could not continue working.

Jacobs was 44 at the time of the accident.  In the Tuesday (March 17, 2015) jury verdict, Jacobs was awarded approximately $21.99 million and his wife approximately $3.96 million.

An excerpt from the March 18, 2015 Chicago Tribune article titled “Jury awards $26 million to lawyer injured in 2005 taxi crash“:

Marc and Debbie Jacobs filed a lawsuit accusing the driver, Cornelus C. Ezeagu, of negligence. Their lawsuit also named the owner of the cab, Matthew Ezeagu, as well as Yellow Cab Affiliation, Inc., and other companies, but the verdict was against the driver and Yellow Cab only.

Jacobs suffered “injuries of a personal and pecuniary nature” and his wife suffered “loss of services, support, affection, society, companionship and consortium of her husband,” according to the complaint.

Recent Chicago Pedestrian Accidents

Recently, there have been a number of fatal Chicago pedestrian accidents.  Some of these involved “hit & run” drivers.

It should be noted that at least one of the recent Chicago fatal pedestrian accidents happened as the pedestrians were walking in a crosswalk.  Unfortunately, just because a pedestrian is in a crosswalk does not necessarily guarantee safety.  As mentioned on the Illinois Pedestrian Accidents page mentioned above,  pedestrian accidents in Chicago often occur at intersections even when people are crossing the street with the “walk signal.”  The accidents occur when the drivers fail to yield to the pedestrians.

Wrongful Death Lawsuit Filed Regarding Chicago Pedestrian Accident

On March 6, 2015 there was a fatal Chicago pedestrian accident involving a semi truck striking Elizabeth Peralta-Luna, 30, of Chicago and her two children as they were walking in a Chicago crosswalk.  Chicago Police at the time of the accident cited the driver of the truck, identified as Zachary Barngrover, 23, of Iowa, with failing to yield to a pedestrian at a crosswalk as well as making an improper left turn.

An Illinios wrongful death lawsuit has been filed regarding the accident.  The lawsuit was filed Monday (March 9) in Cook County Circuit Court by Peralta-Luna’s aunt, Maricela Ruiz. It names Barngrover and the Monson & Sons trucking company as defendants.

The lawsuit makes a variety of allegations.  An excerpt from the March 9, 2015 Chicago Tribune article titled “Lawsuit filed against semi driver in accident that killed woman, 2 kids“:

The lawsuit claimed that when turning left from 43rd Street onto Ashland on Friday, Barngrover failed to keep a proper lookout and failed to yield and give the right-of-way to Peralta-Luna and her two kids. The lawsuit also claimed the driver was using a cellphone while driving.

Traumatic Brain Injury Resources

Traumatic brain injury (TBI) is sometimes experienced in various types of accident injuries, including vehicle accidents, nursing home accident injuries, and other types of injuries, including those in sports.

The Centers for Disease Control and Prevention (CDC) announced on March 2, 2015 that March is Brain Injury Awareness Month.

As stated by the CDC:

A TBI is caused by a bump, blow or jolt to the head and can affect how a person feels, thinks, acts, and learns. A TBI not only impacts the life of an individual and their family, but it also has a large societal and economic toll.

The CDC offers safety tips to help prevent TBI, including reminders to wear seat belts while traveling in vehicles; using appropriate car seats; and for sports, wearing appropriate helmets.

Illinois Lawsuit Regarding Sidewalk Bicycle Accident

Accidents and injuries involving poorly maintained sidewalks are discussed in a number of posts on this site.  As one would expect, many of these accidents and injuries are those involving “trip and fall” accidents, in which a person is walking on the sidewalk and trips, falls and sustains injuries.  As seen in some of these accidents and accident lawsuits, injuries can be significant, if not very much so.

A recent lawsuit alleges injuries caused by an allegedly poorly maintained sidewalk that caused a woman to fall off her bicycle and injure herself.  This alleged bicycle accident happened in Lebanon, Illinois, and is discussed in the January 13, 2015 Madison Record article titled “Woman alleges injuries after her bike struck large crack in sidewalk.”  As seen in the article, the lawsuit’s plaintiff, Danielle Long, filed the lawsuit on December 22, 2014 against the City of Lebanon.  The lawsuit cites negligence on the part of the City of Lebanon.

An excerpt:

She blames the city for contributing to her injuries, saying it negligently failed to maintain the sidewalk in a safe condition, failed to repair the sidewalk, failed to warn bicyclists that its sidewalk was not safe, failed to prevent vehicles from parking along the street and failed to enforce no parking signs on College Avenue.

Chicago Area Dog Attack Injuries

Dog bites and other attacks in the Chicago area as well as throughout Illinois continues to be a significant problem.  As discussed on the “Illinois Dog Bites” page, on a national scale there are 4.5 million dog bites annually, with one in five causing injuries that require medical attention.  Some recent notable dog attacks in the Chicago area – including one fatal dog attack – are discussed in posts found under the “Illinois Dog Attacks” category.

The severity of injuries caused by dog attacks can be notable, especially when the victim is a child.  A recent lawsuit filed regarding an alleged Louisiana dog attack, involving a pit bull attacking a 4-year-old boy, is an example of a lawsuit that was filed in which the victim allegedly suffered multiple serious injuries, including lacerations to the boy’s skull.

Illinois Wrongful Death Lawsuit Alleges Incorrect Medical Diagnosis

Incorrect medical diagnoses are often the cause of injury and/or death in Illinois health care facilities, such as nursing homes and hospitals.

There has been a wrongful death lawsuit filed against Palos Community Hospital and two of its doctors.  This lawsuit alleges that they failed to diagnose a patient’s brain bleed that caused a fall that led to the patient’s (Charles E. Von Schlutter) death.

The lawsuit and its claims are summarized in a variety of media sources, including the February 25, 2015 Palos Patch article titled “Doctors’ Missed Diagnosis Led to Fall that Caused Man’s Death:  Lawsuit” as well as the Cook County Record article of February 25 titled “Doctors’ failure to diagnose brain bleed led to man’s death.”

An excerpt from the Palos Patch article:

Von Schlutter was a patient at the hospital, 12251 S. 80th Ave., when he fell on March 12, 2013. He ”suffered cerebral injuries” according to the complaint, which McCain alleges the doctors failed to test for, diagnose, and properly treat. The brain bleed caused the fall which led to Schlutter death March 28, 2013.
