Fatal Franklin County ATV Accident

There was a fatal ATV (“four-wheeler”) accident Saturday night (June 20, 2015) in Franklin County (Illinois.)

The Franklin County Sheriff’s Department responded to an emergency call at approximately 9:00 p.m. regarding an ATV accident that injured two males.  The accident happened on Number 10 Road west of Logan.

The accident happened after the ATV hit a tree that had fallen across the road.

As a result of the crash, two of three people on the ATV were injured, one fatally.

Sergio Mendez, 14, of Benton, was declared dead at the accident scene, after having suffered head trauma.

Another rider, Abraham Romero, 29, was taken to Franklin Hospital for treatment of his accident injuries.

“Slip & Fall” Suit Against Bethalto Restaurant

A recent Illinois “slip & fall” lawsuit illustrates an alleged “slip & fall” accident that happened at the McDonald’s in Bethalto.  The lawsuit is discussed in the April 2, 2015 Madison Record article titled “Customer sues Bethalto McDonald’s over slip and fall.”

The lawsuit alleges that a customer, Freda Balesmalson, fell on a slippery floor.

The defendant denied the allegations in its April 6 answer, claiming the plaintiff’s own negligence contributed to her alleged injuries.

McDonald’s accuses her of failing to keep a proper lookout, failing to heed the warning signs placed throughout the store, failing to heed the fact that it was raining and she should have expected the ground to be wet as a result and failing to use the counter as a handhold while walking on the allegedly wet ground.

Fatal Work Accident On Chicago’s Far South Side

There was a fatal workplace accident Monday (June 15, 2015) on Chicago’s Far South Side.

The accident involved an employee of the Horsehead Corp. falling into a silo at approximately 12:30 p.m.  After being pulled from the silo, the man was taken to Roseland Community Hospital.

According to the Cook County Medical Examiner’s Office, the man, Andrew Brundidge, 56, of Calumet City, was pronounced dead at 2:35 p.m.

An excerpt from the June 15, 2015 myfoxny.com article titled “OSHA investigates man’s death after falling into silo on Far South Side“:

Brundidge’s job was to operate conveyor belts that feed dust into holes in the tops of the silos, according to the Occupational Safety and Health Administration, which has launched an investigation into the fatality.

He was controlling the flow of dust into four silos when he fell about 30 feet into the bottom of one of the silos, according to OSHA’s statement.

Illinois Lawsuit Regarding Fall Into Manhole

Various posts on this site have discussed accidents and injuries involving poorly maintained sidewalks.  As one would expect, many of these accidents and injuries are those involving “trip and fall” accidents, in which a person is walking on a sidewalk (or other walkway) and trips, falls and sustains injuries.  These types of accidents are similar to “slip and fall” accidents, from which many people have been injured.  Various alleged “slip and fall” accidents are posted under the “Slip & Fall” accidents category.

A recent lawsuit alleges that a mother (Shelia DeBoise) and her baby suffered various injuries after they fell into an improperly covered manhole in Madison, Illinois.  The lawsuit and its details are discussed in the May 25, 2015 Madison Record article titled “Mother and baby allegedly injured after falling into manhole.”

On May 11, 2014, DeBoise, while returning home and carrying her baby, claims she stepped on a manhole cover on Foschiatti’s property, which allegedly flipped and caused her to fall into the manhole. She claims her baby was thrown from her arms and struck her head in her own fall, the suit states.

The lawsuit alleges the mother suffered a leg injury, pain and suffering, medical expenses, lost wages and benefits, and disability. It also claims her baby suffered injuries to his face and head, pain and suffering, additional medical expenses for his mother and disability.

Wrongful Death Lawsuit Regarding Downtown Chicago CTA Bus Crash

There has been a wrongful death lawsuit filed regarding the fatal CTA bus crash that happened in downtown Chicago on June 2, 2015 on Lake Street at Michigan Avenue.

In that accident, Aimee Coath was the sole person who was fatally injured, and the wrongful death lawsuit has been filed by the Coath’s children against the bus driver and the CTA.

An excerpt from the June 9, 2015 Homewood-Flossmoor Patch titled “Children of Flossmoor Woman Killed in Crash File Lawsuit Against CTA“:

In the wrongful death lawsuit, Elaine and John Wilson claim that the driver “failed to control the bus, disregarded a red light and drove at an excessive speed” before striking Aimee Coath. She was pinned under the bus.

The driver, Donald Barnes, 48, swerved to avoid another car, struck three other cars and ended up on the south side of a pedestrian plaza on Michigan Avenue. Seven other people were also injured. He was cited for running a red light and failing to exercise due care in a deadly crash. The bus was empty at the time of the crash.

Pool Accident In Warrenville, Illinois

There has been an accident at a pool in Warrenville, in which a four-year-old girl was injured.

Details on this accident, and its causes, are very limited at this time.  It is unknown if negligence or improper safety procedures contributed to this pool accident.

According to authorities, the girl was found by staff members at the bottom of the pool at the Lifetime Fitness swimming pool at approximately 2:20 p.m. Thursday, June 4, 2015.

The girl was unresponsive, and was taken to Edward Hospital in Naperville for treatment of her injuries, where she remains on life support.
