Two Examples Of Illinois “Trip & Fall” Lawsuits

On this site, accidents that are considered to be “slip and fall” and “trip and fall” are discussed in posts seen in the “Slip & Fall” category.

Many of these types of accidents involve claims of improperly maintained infrastructure.  This may include such structural deficiencies including (large) potholes, crumbling sidewalks, cracked sidewalks, rusting signs and poles, and holes and sinkholes.

The October 20, 2015 Madison Record article titled “City of Belleville seeks to dismiss suit alleging resident was injured after stepping into pothole” discusses a lawsuit filed by a resident (Linda Braboy) who claims she was injured after stepping into a hole that was covered by grass.

A notable excerpt from the article:

The defendant also alleges immunity under the Illinois Local Governmental and Governmental Employees Tort Immunity Act.

Another “trip and fall” lawsuit is seen summarized in the Madison Record article of October 20, 2015 titled “Texas Roadhouse removes trip and fall suit to federal court.”  This article summarizes a lawsuit in which the underlying trip and fall accident involved a woman who allegedly tripped and fell on a raised rug at a restaurant, and sustained “severe and permanent injuries” as a result of the accident.  The article also describes the negligence claimed in the lawsuit.  Additional details can be seen in the Madison Record article.

Injuries Caused By Improperly Maintained Roads

Accidents which are caused by improperly maintained infrastructure occur, and some cause serious injuries.  On this site, various such injuries have been discussed.

Often, accidents of this type happen on roads and sidewalks.  These types of accidents include people who are injured after tripping and falling on broken pavement and sidewalks; people injured when infrastructure – such as light poles – falls or collapses; and people injured when they trip or step into a pothole.  Another example might include a car accident that is caused by a driver hitting a large pothole.

A recent lawsuit involving a man who alleges he was injured when he fell into a sewer in Granite City is seen in the November 3, 2015 Madison Record article titled “Granite City denies liability in suit alleging man fell in sewer.”  As seen in the article, the man claims he was injured when, after an auto accident, he stepped onto a manhole cover and fell into a sewer.  Additional details can be seen in the Madison Record article mentioned above.

Illinois Trip & Fall Lawsuit

Illinois “slip & fall” accidents are common, and are discussed on the “Illinois Slip & Fall Accidents” page.  As well, various posts that feature “slip & fall” accidents can be seen under the “Slip & Fall” category.

Another common type of accident, that can cause various serious injuries, are those considered to be “trip & fall” accidents.  Various incidents of “trip and fall” accidents that caused injuries can also be seen in the “Slip & Fall” category.

An October 20, 2015 Madison Record article titled “Texas Roadhouse removes trip & fall suit to federal court” discusses a recent alleged “trip & fall” accident in O’Fallon and cites the following aspects of the alleged negligence:

According to the complaint, Beliveau claims she was leaving the O’Fallon restaurant, located at 1412 Central Park Circle in O’Fallon, on July 1 when a “raised and uneven rug caused her to fall and strike her head on a door jamb, causing her severe and permanent injuries to her head and body.”

She accuses the defendant of negligence for failing to provide a safe entrance and exit, remove or fix the rug, properly inspect the premises, warn customers about the tripping accident and make the entrance and exit safe for passage.

Additional details can be seen in a variety of media sources, including the Madison Record article mentioned above.

Hazards Caused By Aging Chicago Infrastructure

Unsafe public infrastructure is a cause for concern, especially if such infrastructure has degraded to the point where it can easily cause injuries and/or death, or has already done so.  On this site, various posts concerning unsafe sidewalks and other hazardous infrastructure that has caused injuries can be seen in the Slip & Fall category and elsewhere.

On November 16, 2015 CBS Chicago had an investigative segment concerning the potential hazards – and injuries – caused by rusting light poles in Chicago.  The segment (with video) is titled “2 Investigators – Rusty Light Poles A Danger Across Chicago.”

Two excerpts from the accompanying article:

Rusty, dangerous light poles are posing a danger to pedestrians and motorists. Hundreds have fallen over and dozens of people have been injured.

also:

Potentially dangerous poles were even near Betty Shabazz International Charter School, where years earlier a problem pole fell on Karen Nelson’s daughter.

“My daughter was crushed,” Karen Nelson says of her child, Noni Brown, who suffered a spinal injury.

Additional details concerning this hazard can be seen in the CBS Chicago segment mentioned above.

Dog Attack In Chicago’s Little Village Neighborhood

There was a dog attack on Thursday (November 12, 2015) in Chicago’s Little Village neighborhood.

First responders were called to an apartment in the 2300 block of S. Whipple Street at approximately 11:00 a.m.  This dog attack involved a woman being attacked by the family dog, a pit bull.

The woman, identified as being 34 years old, was taken to Mt. Sinai Hospital for treatment of several dog bite injuries.  She was said to be in critical condition.

An excerpt from the November 12, 2015 abc7chicago.com article (with video) titled “Disabled woman attacked by family dog, critically injured“:

Sources said the dog had puppies recently and the woman was cleaning the floor and apparently didn’t see one of the puppies. The mother dog then turned on the woman biting her in the arm, neck and face.

Additional details and possible updates concerning this Chicago dog attack can be seen in a variety of media sources, including the abc7chicago.com article mentioned above, as well as the November 12 CBS Chicago article titled “Woman Bitten By Dog, Critically Injured In Little Village” and the November 12 Chicago Sun-Times article titled “Woman in critical condition after being bitten by pit bull.”

Lawsuit Filed Over Wilmette Car Collision

There has been an Illinois personal injury lawsuit filed over a July 18, 2015 car accident in Wilmette.

James Schurr filed the lawsuit against Homer Askounis, 92, of Chicago.

According to the accident lawsuit, the collision occurred as Askounis was driving northbound on Skokie Road near Central Avenue in Wilmette.  At that time, Askounis drove into oncoming traffic, thus hitting Schurr’s car in a “head-on” collision.

The lawsuit alleges that Schurr, as a result of the accident, incurred “severe injuries” that has left him unable to work.

The alleged injuries incurred by Schurr are reported to include herniated discs.

The suit, filed recently in the Circuit Court of Cook County, accuses Askounis of “willful and wanton conduct” and said he “carelessly and negligently operated his vehicle in a dangerous and unreasonable manner.” The lawsuit also says Askounis “failed to exercise due care.” It seeks a judgment against Askounis in excess of $50,000 in compensatory damages and unspecified punitive damages.

Additional details and possible updates concerning this Circuit Court of Cook County lawsuit and the underlying accident can be seen in a variety of media sources, including the Wilmette Life article mentioned above, as well as the November 11 Wilmette-Kenilworth Patch article titled “High School Coach Sues 92-Year-Old Man After Head-On Car Accident.”
