Lawsuit Regarding Vehicle Collision

Accidents involving municipal vehicles, such as police cars, ambulances, fire trucks, city vehicles, etc. can present challenges in determining liability and getting accident injury compensation.

A recent article discussed a lawsuit involving a Kane County collision involving an ambulance responding to a call and another vehicle.  The article is seen in the December 27, 2015 Daily Herald article titled “Judge dismisses lawsuit over Geneva ambulance crash.”

Notable excerpts from the article include:

A Kane County judge has dismissed a lawsuit filed by a man seeking damages for injuries sustained in 2011 when he was rear-ended by a Geneva ambulance responding to a call.

also:

Attorneys for the city successfully argued the city and Baum are protected under state law and “are immune from injuries caused by the negligent operation of a motor vehicle when responding to an emergency call,” according to court documents.

According to the article, the underlying accident happened at Kirk Road and State Street, and the roadway may have been covered in black ice.  As those familiar with black ice know, black ice often creates extremely hazardous driving conditions where loss of vehicle control can occur.

Concussions In Sports

On this site, head injuries are discussed extensively, given that such injuries are often suffered in various types of accidents.  Serious head trauma that is not fatal can cause wide-ranging impairments that require substantial medical treatments and rehabilitation.

As well, there is a growing recognition and awareness that head injuries in sports should receive more concern.  Research is now indicating that repetitive head impacts – even if seemingly routine – can, from a long-term perspective, be harmful to one’s long-term health.

Various pages on this site discuss aspects of head trauma, ranging from concussions to Traumatic Brain Injury (TBI).  These pages are:

Concussions

Long-Term Health Consequences Of Repeated Head Impacts

Traumatic Brain Injury

There is growing recognition that repeated head impacts – even if those head impacts are seemingly minor – can accumulate into chronic long-term mental and emotional impairments.  One disease that has been receiving increasing recognition is that of chronic traumatic encephalopathy (CTE.)

There are a number of sports for which routine head impacts are of concern.  The New York Times article of December 13, 2015, titled “How a Boy’s Concussion Death Changed British Sports” discusses deaths in rugby that have been attributed to concussions.

One of the issues regarding concussions – especially in sports – is what is a proper time to refrain from returning to a sport (or other activity) after one receives a concussion?  There is growing recognition that this period of inactivity is critical, as one does not want to aggravate the condition and/or subject oneself to additional head trauma.  An excerpt from the New York Times article mentioned above:

Mr. Robinson did his own research into concussions and learned about second-impact syndrome, or a rapid and severe swelling of the brain that occurs when someone sustains a second concussion before a first one has properly healed.

Additional details regarding these issues can be seen in the media sources mentioned above.

On this site, head injuries are discussed extensively, given that such injuries are often suffered in accidents.  Serious head trauma that is not fatal can cause wide-ranging impairments that require substantial medical treatments and rehabilitation. As well, there is a growing recognition and awareness that even seemingly-minor repetitive head impacts can, from a long-term perspective, lead to a variety of adverse maladies.  The “Long-Term Health Consequences Of Repeated Head Impacts” page discusses adverse health consequences of repetitive head impacts, commonly associated with various sports.

A December 14, 2015 Wall Street Journal article titled “After Concussions, Athletes Are More Injury-Prone” discusses another purported aspect of getting concussions – that of being more prone to other types of injuries.

An excerpt from the article:

Concussion may impair the brain’s ability to coordinate physical movement, the researchers said. Subtle disruptions to brain pathways may increase the interval between reaction and movement time, potentially increasing the risk of subsequent injury, the study suggests.

Additional details on this study may be found in a variety of media sources, including the Wall Street Journal article mentioned above; as well as the abstract of the “Acute Lower Extremity Injury Rates Increase after Concussion in College Athletes” study.

Concussion Injuries In Recent Car Accidents

Concussions and other types of blows to the head are always of concern.  As discussed in this site’s Concussions and Traumatic Brain Injury pages, such injuries should be immediately assessed by a qualified medical professional.  This is because – in short – in many cases the adverse health impact may take a while to become fully apparent.

As well, the issue of the long-term impact of concussions, while not fully understood, is being actively investigated as many believe that damage from repeated concussions can be very detrimental to various aspects of health.

One way in which concussions happen are during car and other vehicle accidents.  A recent pedestrian accident in Chicago’s Wicker Park neighborhood resulted in two of the three pedestrians struck by a car having concussions among their accident injuries.  This accident is summarized in the December 12, 2015  post titled “Wicker Park Pedestrian Accident.”

Another car accident in which a head injury occurred is seen in a December 9, 2015 car crash in Ringwood, Illinois.  That accident is summarized in the December 9 post titled “Single-Car Crash In Ringwood.”

Two Pit Bull Attacks On Children

As seen in various media sources as well as the Illinois dog attack posts seen on this site, dog attacks can and do happen, and the injuries are often severe – if not fatal.  For those attacks in which injuries are not fatal, extensive injuries and disfigurement – including scarring – are common, and substantial medical costs are often incurred.  As such, those who survive severe dog attacks can have a significant need for injury compensation.

Two recent articles serve as further examples of dog attacks on children.  In the first case, an alleged pit bull attack in East Alton, Illinois has led to a lawsuit against the dog’s owner.  The suit is discussed in various media sources, including the October 31, 2015 thetelegraph.com article titled “Suit:  East Alton pit bull mars young girl” as well as the November 23 Madison Record article titled “Man claims daughter was attacked by pit bull in East Alton.”  The suit alleges that a pit bull attacked Brianna Gambino “without provocation.”  As mentioned in thetelegraph.com article:

The father of a St. Louis girl has filed suit against an East Alton pit bull owner, claiming the dog bit the child, causing lacerations and puncture wounds to her right eye and lip.

Additional details and possible updates can be seen in the articles mentioned above.

Another pit bull attack on a child, causing a fatality, is discussed in the December 4, 2015 Chicago Tribune article (with video) titled “Detroit preschooler fatally mauled by pack of pit bulls.”  In this article, in addition to the attack, there is discussion as to whether pit bulls are more inclined to aggression, and statistics are cited.
