Lawsuit Settled Over Bicycle Accident Caused By Pothole

Deteriorating infrastructure – which includes poorly-maintained street lights and streets with potholes – have caused a variety of accidents in the Chicago area.  Some of these accidents and accompanying injuries have been summarized on this site.

Poorly maintained streets – which often have large potholes – can pose a significant safety hazard for bicyclists and motorcyclists, who can easily lose control if they hit a pothole.  The loss of control can easily lead to a crash which may cause accident injuries.

A bicycle accident in Los Angeles in which a bicyclist allegedly hit a pothole, which caused him to fall and seriously injure himself, happened in May 2015.  The man filed a lawsuit against the City of Los Angeles, which agreed to settle the lawsuit for $6.5 million.  The man’s injuries, according to the lawsuit, included a severe traumatic brain injury (TBI).

An excerpt from the September 6, 2017 Los Angeles Times article titled “Los Angeles OKs $6.5 million to settle lawsuit after cyclist hit a pothole.”  An excerpt from the article:

Two years ago, Peter Godefroy lost control of his bicycle when it hit a pothole on Valley Vista Boulevard, throwing him to the ground. The crash left him with broken bones and a severe traumatic brain injury, according to his suit.

He and his wife, Patricia, sued the city, the county and the state, arguing that the street he was bicycling on was so poorly maintained that it had created a “concealed trap for bicyclists.” As a result of government negligence, the lawsuit claimed, Godefroy had suffered injuries so severe that he expected to have “some permanent disability.”

The Los Angeles City Council voted 11 to 0 on Wednesday to approve the $6.5-million settlement.
