Improperly Maintained Sidewalk Focus Of Lawsut Against Joliet

A common accident involving unsafe infrastructure is when there is a “trip and fall” accident involving an improperly maintained sidewalk.  Often, these sidewalks will have broken concrete or some other abnormal condition which may cause a person to lose their balance and trip.  If the person then falls, they may be injured during this fall.  Many “trip and fall” accidents that have been featured on this site have resulted in a range of serious injuries.  Some of these injuries have caused temporary or permanent physical impairments.

The May 10, 2018 Joliet Patch article titled “Joliet Slip, Fall Lawsuit Settled For Six Figures” discusses a lawsuit naming the City of Joliet as well as the Pace bus service as defendants.  The alleged accident involved a woman (Estella Jurkovich, the plaintiff) who fell after tripping on a Joliet sidewalk near Plainfield Road and Connecticut Avenue.

An excerpt from the article:

The 2013 lawsuit accused Joliet of negligence by “failing to properly inspect the sidewalk upon which the public could walk” and also having “failed to provide a safe walking surface.”

Next month will mark five years since Jurkovich took her tumble to the ground, not far from the Tezak Funeral Home, the lawsuit notes. The lawsuit states that Jurkovich “was caused to fall and be severely injured as a result of the unsafe conditions” of the city sidewalk.

The article further discusses the effect of the injuries and other adversities (including pain and anguish) allegedly caused by the accident.

Additional details and possible updates concerning the lawsuit concerning the improperly maintained sidewalk can be seen in the article.

Negligent Maintenance Claimed In Sidwalk “Trip & Fall” Lawsuit

On this site, many injuries and deaths (as well associated lawsuits) that have been caused by alleged negligent maintenance of unsafe infrastructure have been discussed.  In most instances, these accidents and accompanying injuries are caused because the infrastructure (including sidewalks, streets, sewers, buildings, bus shelters, etc.) has not been properly maintained.  An unsafe condition can develop, which can cause injuries, some of which can be life-threatening to those who have been hurt.

Many of these injuries require hospitalization as well as follow-up medical care, such as tests, surgeries, and rehabilitation.  In many instances lawsuits are filed against the person, company, or other entity (such as a city or state) that owns the infrastructure and has been negligent in its maintenance and/or operation.  These lawsuits typically seek compensation for medical costs, impairments, pain and suffering, any lost wages, and other adversities caused by the injuries.

There was a lawsuit filed against the Village of Bethalto over an alleged incident in which a woman tripped and fell on a sidewalk.

The lawsuit and alleged injuries are discussed on the April 25, 2018 Madison Record article titled “Woman sues Bethalto over sidewalk trip, fall.”  An excerpt:

According to the complaint, the plaintiffs allege that on May 12, 2017, Bonnie Coleman was using the public sidewalk located on Woodcrest Drive when she tripped and fell over reinforcement steel used in a concrete manhole.

Coleman claims she sustained severe and permanent injuries that prevented her from attending to her usual duties and affairs. She also claims she has suffered great pain, mental anguish and incurred medical expenses.

Additional details regarding the lawsuit, including claims regarding how the Village was negligent, can be seen in the article.
