Jury Award Concerning O’Hare Shelter Collapse That Paralyzed Woman

There have been many serious injuries – including some fatal – that have occurred due to poorly maintained infrastructure in Chicago and the Chicago area.  Many of these accidents and accompanying injuries have been summarized on this site.

The causes for these accidents is broad, and the infrastructure involved can take many forms.  Common causes for such accidents include infrastructure that is old (past useful life) and/or dilapidated, or hasn’t been properly maintained.  Infrastructure involved includes unsafe sidewalks, streets, sewers, roofs, street lights, and traffic signal poles.

Another type of infrastructure that is prone to collapse is public shelters, such as those at bus stops.

One such shelter collapse happened when high winds occurred at O’Hare Airport on August 2, 2015.  This accident was summarized in the post of August 14, 2015, titled “Lawsuit Filed Over Shelter Collapse At O’Hare Airport.”  While several members of a family were injured when the pedestrian shelter collapsed, one person, Tierney Darden, was paralyzed.

The trial over the personal injury lawsuit ended on August 23, 2017.  The jury in the Cook County jury trial awarded Tierney Darden $148 million.

The jury award is summarized in a number of media sources, including the August 23, 2017 dnainfo.com article titled “$148 Million Awarded To Dancer Paralyzed In O’Hare Bus Shelter Collapse” as well as the August 23 CBS News article titled “Jury awards $148M to woman paralyzed after airport accident.”  An excerpt from the dnainfo.com article:

Family members said the suburban woman, a former dancer and student at Truman College, has been in constant pain since the accident on Aug. 2, 2015. She was returning to Chicago from a trip to Minneapolis to shop for bridesmaid dresses when a storm came through the area and a pedestrian shelter weighing 750 pounds loosened and fell on top of her.

also:

She is now paralyzed from the waist down and a pain expert testified her spine “stretched until it popped and ripped.”

Attorneys said the shelter was missing bolts, and an investigation “found other shelters at O’Hare that were poorly maintained with missing bolts, corroded parts or broken brackets.”

Additional information can be seen in the sources mentioned above.

Trip & Fall Accident Lawsuit

On this site there have been a number of injuries discussed that can be considered “trip and fall” accidents.  These accidents are seen in posts listed in the “slip and fall” category.

Many of these accidents and their injuries have to do with deteriorating infrastructure, including improperly maintained sidewalks.  Sidewalks that are crumbling and/or otherwise uneven can cause people to trip and fall.

A recent lawsuit regarding such an accident in Alton – in which a man allegedly tripped on a hole in the sidewalk while jogging, causing him to fall – is discussed in the Madison Record article of January 7, 2017, titled “Jogger sues City of Alton over hole in sidewalk.”

Two excerpts regarding the personal injury lawsuit and its claims of negligence:

Christopher Everage filed a complaint on Dec. 23, in the Madison County Circuit Court against the City of Alton, alleging the municipal corporation breached its duty to maintain the sidewalk in a reasonably safe condition.

also:

The plaintiff alleges the City of Alton failed to inspect and repair the hole on the sidewalk and failed to barricade or otherwise warn users of the sidewalk.

The lawsuit claims various injuries and other harm stemming from the accident.

Additional details and possible updates can be seen in a variety of media sources, including the Madison Record article mentioned above.

Lawsuit Regarding Vehicle Collision

Accidents involving municipal vehicles, such as police cars, ambulances, fire trucks, city vehicles, etc. can present challenges in determining liability and getting accident injury compensation.

A recent article discussed a lawsuit involving a Kane County collision involving an ambulance responding to a call and another vehicle.  The article is seen in the December 27, 2015 Daily Herald article titled “Judge dismisses lawsuit over Geneva ambulance crash.”

Notable excerpts from the article include:

A Kane County judge has dismissed a lawsuit filed by a man seeking damages for injuries sustained in 2011 when he was rear-ended by a Geneva ambulance responding to a call.

also:

Attorneys for the city successfully argued the city and Baum are protected under state law and “are immune from injuries caused by the negligent operation of a motor vehicle when responding to an emergency call,” according to court documents.

According to the article, the underlying accident happened at Kirk Road and State Street, and the roadway may have been covered in black ice.  As those familiar with black ice know, black ice often creates extremely hazardous driving conditions where loss of vehicle control can occur.

Lawsuit Filed Over Wilmette Car Collision

There has been an Illinois personal injury lawsuit filed over a July 18, 2015 car accident in Wilmette.

James Schurr filed the lawsuit against Homer Askounis, 92, of Chicago.

According to the accident lawsuit, the collision occurred as Askounis was driving northbound on Skokie Road near Central Avenue in Wilmette.  At that time, Askounis drove into oncoming traffic, thus hitting Schurr’s car in a “head-on” collision.

The lawsuit alleges that Schurr, as a result of the accident, incurred “severe injuries” that has left him unable to work.

The alleged injuries incurred by Schurr are reported to include herniated discs.

The suit, filed recently in the Circuit Court of Cook County, accuses Askounis of “willful and wanton conduct” and said he “carelessly and negligently operated his vehicle in a dangerous and unreasonable manner.” The lawsuit also says Askounis “failed to exercise due care.” It seeks a judgment against Askounis in excess of $50,000 in compensatory damages and unspecified punitive damages.

Additional details and possible updates concerning this Circuit Court of Cook County lawsuit and the underlying accident can be seen in a variety of media sources, including the Wilmette Life article mentioned above, as well as the November 11 Wilmette-Kenilworth Patch article titled “High School Coach Sues 92-Year-Old Man After Head-On Car Accident.”

Illinois Motorcycle Collision Lawsuit

Illinois motorcycle accidents are frequently traumatic, and often involve negligent actions by other motorists.  As stated on the Illinois Motorcycle Accidents page:

Due to the vulnerability of a motorcyclist, as well as travel at significant speeds, many motorcycle accidents cause serious injuries, and accidents often result in death.  Motorcycle injuries often include chest trauma, broken bones, bleeding, injuries to the back, spinal cord injuries/paralysis, and various brain injuries and other head trauma.

A recent Illinois motorcycle accident lawsuit serves as an example of a motorcycle accident that resulted in a lawsuit, including the types of claims such a lawsuit may contain.

The lawsuit, which was filed in St. Clair County Court on July 17, 2015, is discussed in the Madison Record article of August 5 titled “Injured motorcyclist alleges negligence in accident.”

As seen in the article, the motorcycle accident involved an accident on West Main Street near North 16th Street in Belleville, when a parked car allegedly pulled out in front a motorcycle, thus causing a collision.

An excerpt from the article concerning the claims seen in the suit:

The suit says the defendant failed to keep a proper lookout, negligently and carelessly failed to control her vehicle, thus striking the plaintiff’s motorcycle.

The plaintiff alleges severe and permanent injuries, physical pain, mental anguish, disability and disfigurement. The suit says Warnecke is unable to attend to his usual daily affairs and duties, has lost wages and suffered loss of future earning capacity. The plaintiff also alleges property damage to his motorcycle and ongoing past, present and future medical expenses.

Additional details and possible updates concerning this Illinois motorcycle accident lawsuit can be seen in a variety of media sources, including the Madison Record article mentioned above.
