Illinois Injury Lawsuits Filed Regarding Naperville Pedestrian Accident

There have been two Illinois personal injury lawsuits filed over a Naperville pedestrian accident that happened on July 12, 2013.  The underlying accident involved a car that struck two pedestrians during a Waubonsie Valley High School driver’s education class.

The teen driver from Naperville was 15 years old at the time of the accident.  According to the police accident report, the accident happened after the teen driver made a right-hand and  “somehow kept pressing the gas pedal instead of the brake” and lost control of the car.  The car jumped the curb, ran over a parking sign, and then struck two female pedestrians, including a mother who was pushing a stroller.

While the mother was able to push the stroller away from the oncoming car, both women were injured and taken to Edward Hospital and Health Services in Naperville for treatment of injuries.

The other victim (the one not with the stroller) claims in the lawsuit that she sustained injuries “to her muscles, bones and nervous system.”

An excerpt from the TribLocal Naperville & Lisle article of July 15, 2014, titled “Naperville student sued for striking pedestrians in driver’s ed class“:

The student driver, now 16, was ticketed for failure to reduce speed to avoid an accident and improper lane usage, according to the police report and court records. The latter ticket was dismissed, and she was placed on court supervision and fined more than $300 for failing to reduce speed, records state.

ATV Safety Issues For Teenage Riders

All-terrain vehicle (ATV) and UTV safety has been a continual concern given the frequency and extent of accidents and injuries, especially those involving teenagers and children.

Medline Plus (National Institutes of Health) published a document today (July 14, 2014) titled “Teens, ATV a Dangerous Combo.”  The article discusses a study’s findings regarding Iowa teens and the incidence of ATV accidents and injuries.

A couple of excerpts:

“More kids younger than 16 are dying from ATV crashes than from bicycle crashes. We talk a lot about bicycle safety, but there isn’t enough discussed with kids and families about safety when riding an ATV,” said study author Dr. Charles Jennissen, a clinical associate professor of pediatrics and emergency medicine at the University of Iowa Carver College of Medicine.

Since 2001, kids aged 15 and younger have represented nearly 30 percent of all ATV-related injuries and one-fifth of ATV-related deaths in the United States, the authors said in their study, which appears in the July/August issue of the Annals of Internal Medicine.

Previous studies have indicated that young ATV operators have a 12 times greater risk of injury compared with adults, the study authors noted.

For example, an ATV’s tires are designed for off-road use. “They aren’t designed for road surfaces,” she said. “They make it more difficult to control and easy to crash. And on the road, in an accident with a car, the car always wins.”

$746,000 Jury Verdict In Illinois Slip & Fall Lawsuit

Slip & Fall Jury Verdict

Anthony R. Elman of the Elman Law Group, LLC has successfully achieved a $746,000 gross jury verdict on a slip & fall rotator cuff injury (less 20% for comparative negligence) after a week-long trial involving a slip & fall lawsuit filed on behalf of a 76-year-old woman. The case, Geneva Lewis vs. Pierre’s, was tried in Chicago (Cook County Court) Illinois.

Elman Law Group took the case to trial after there was no settlement offer from the in-house insurance defense law firm of Maisel and Associates of Traveler’s Insurance Co.

The Slip & Fall Injury

The case involved a 76-year-old plaintiff (Geneva Lewis) who, on February 25, 2009, suffered a rotator cuff tear injury that was caused by a fall allegedly because of a wet floor in Pierre’s Bakery (the defendant) in Blue Island, Illinois. The plaintiff had arthroscopic surgery about year and a half after the accident.

Defendant argued that the floor was completely dry and that there were warning signs present throughout the bakery floor from two hours earlier when the floor was last mopped.  Defendant employees also testified that the floor was inspected after the accident and it was dry. Defense further contended that the 76-year-old plaintiff’s injury to her right shoulder was caused by degenerative arthritis due to her old age.

Plaintiff’s medical bills were $85,000. Anthony Elman’s last settlement demand was $250,000, and he requested $1,500,000 from the jury in closing arguments at the jury trial.

The trial occurred from June 17 – June 20, with Judge Michael Panter.

$180 Million Awarded In Chester, Illinois Grain Elevator Explosion

Three men who were badly injured during an explosion in a grain elevator in Chester, Illinois, were awarded $180 million.

The award was comprised of punitive damages totaling $100 million and compensatory damages for the remaining $80 million.

Compensatory damages will be roughly split among the victims in the following amounts: $41.5 million to John Jentz of St. Peter, Minnesota; $34 million to Justin Becker of Cedar Rapids, Iowa; and $2.9 million to Robert Schmidt of Hutchinson, Minnesota.

An excerpt from the MyFoxChicago story of June 4 titled “$180M for 3 hurt in Chester grain elevator blast” :

During the trial, their attorneys argued that not only had the bin not been properly cleaned in nearly two decades, but that for weeks the company had been warned that the bin could explode at any moment — warnings it did not act upon or even share with the three victims and other workers.

The grain elevator was owned by ConAgra, who says it will appeal the decision.

The explosion, which severely injured the victims, happened when the men were removing equipment from a concrete grain bin at ConAgra’s site, and the bin exploded.

Poorly Maintained Chicago Sidewalks
